DIVORCE

Mr. Herlihy has a breadth of experience and expertise in contested and uncontested/amicable divorces, mediation of divorce cases, same-sex/LGBTQ divorces, gray divorces, and trials.


CONSERVATORSHIP
AND CUSTODY

Minor children and their needs and best interests are paramount. Mr. Herlihy makes it a priority to ensure the best custody arrangements are put in place - whether by negotiation and agreement or through court orders. He has deep experience in dealing with a wide variety of conservatorship and custody arrangements and makes sure that all details are addressed to best suit the children and his clients’ interests. He has helped numerous clients overcome a myriad of challenges in cases and has helped craft a variety of non-standard schedules and arrangements that are best suited for his clients over the years. Along with conservatorship and possession and access issues, Mr. Herlihy has extensive experience with child support establishment and all of the issues related to the support of minor children.


PRE-NUPTIALS

Mr. Herlihy has experience and expertise in asset characterization, the division of complex and high-value asset estates, real estate, businesses, retirement accounts (IRAs, 401(k)s, annuities), crypto, pensions, stock and stock options, RSUs and company equity, trust accounts, health and life insurance policies, vehicles, personal property, and high-value collections, both domestic and internationally.


POST-NUPTIALS

A prenuptial agreement can protect both parties and save couples from divorce by offering full financial disclosure. Reasons for a prenuptial agreement can include minor children from previous relationships, pets, businesses, and the desire for certainty as to asset division in the event of a divorce.


ASSET DIVISION

Post-nuptials help couples feel more confident about community assets in the event of a divorce, disclosing the estate and helping agree on ownership.


REAL ESTATE

In addition to family law, Mr. Herlihy has considerable experience in real estate law, including property disputes, commercial and residential real estate litigation, and evictions.


CONTRACT LITIGATION

When a contract is broken, or its terms are disputed, contract litigation may become necessary for relief or remedy. Mr. Herlihy has significant experience handling contract litigation of various types and forms outside of the family law arena.
