Scott Herlihy is a proven and skilled family law attorney who has practiced in Travis, Williamson, and Hays counties for over 25 years. He is licensed in all Texas state and federal courts and was selected as a “Rising Star” by Texas Monthly Magazine in 2005 and 2006, an honor bestowed upon less than 2.5% of attorneys under 40. In 2024, Scott was awarded an AV Preeminent rating by Martindale Hubbell, an award given to attorneys who are ranked at the highest level of professional excellence for their legal expertise, communication skills, and ethical standards by their peers. Scott is a member of the State Bar Family Law and Litigation Sections, the Travis County, Williamson County, and Hays County Bar Associations, the Austin Bar Association Family Law and Litigation Sections, and is an Austin Bar Foundation Fellow.
Scott handles a wide range of family law matters, both contested and uncontested, including divorces involving high-asset and complex estates as well as more modest asset and property divisions, prenuptial and postnuptial agreements, modifications of Texas and out-of-state orders, custody disputes, establishment and enforcement of child support, enforcement of property division and parental conservatorship rights and duties, orders for possession of and access to children, paternity cases, and matters relating to grandparents’ and other non-parental rights.
In addition, Scott has significant experience in handling both civil and commercial matters. Scott has represented individuals and businesses as both plaintiffs and defendants in a wide variety of civil cases, including contract disputes, construction cases, insurance disputes, collections cases, real estate and property disputes, and disputes between businesses and between owners of businesses.
Leading a client-centered practice, Scott makes himself highly available to his clients and takes the time to listen so that he understands all of their needs and concerns. He understands that dealing with the legal process can be difficult and stressful, so it is important to him that his clients have the utmost confidence and trust in him, are fully informed of all matters in their case, and are comfortable with their working relationship. Scott’s clients’ best interests are always paramount.
Scott Herlihy received his undergraduate degree from Southwestern University in Georgetown, Texas in 1992 and his J.D. cum laude from St. Mary’s University School of Law in San Antonio, Texas in 1997. While in law school, Scott was the Research Editor of the St. Mary’s Law Journal in 1997 and a Staff Writer with Honors in 1996. He also interned with the Supreme Court of Texas.
When it’s not football season, Scott can be found gardening or with a book. When it is football season, he’s participating in Fantasy Football, which he’s been doing for almost 30 years. Additionally, he enjoys cooking, traveling, going to the movies, museums, galleries, and concerts, and having new adventures with his wife, Amanda. They are UT sports fans and can often be found at DKR on game days.
